Terms of Use

1. AGREEMENT TO LEGAL TERMS

These Terms of Use ("Terms") are a legal agreement between you and PurrfectPlan ("Company", "we", "us", "our"), registered in Ukraine at Poliarna Street 11, Kyiv, 02000. We operate the PurrfectPlan mobile application (the "App") and related services (the "Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

Age: The Services are intended for users 13+. In jurisdictions where a higher minimum age of consent applies, users below that age must have parental or guardian permission and supervision.

We may update these Terms by posting a new version with a new Effective date. Continued use means acceptance.

2. OUR SERVICES

PurrfectPlan is a productivity and lifestyle app: projects and tasks, habits, lists, simple budgeting and saving goals, personal reflections, and a Life Balance Wheel with lifestyle (non-medical) tips.

The App includes optional AI-powered features ("AI Features"), including personalized onboarding setup, in-app chat assistance across all modules, and lifestyle recommendations. As of the date of these Terms, AI Features are powered by Anthropic, PBC ("AI Provider"). Your use of AI Features involves the transmission of certain data to our AI Provider as described in our Privacy Policy. AI Features are optional; core App functionality is available without using AI Features.

The Services are not designed to comply with industry-specific laws (e.g., HIPAA, GLBA, FISMA). Do not use the Services where such laws apply.

3. INTELLECTUAL PROPERTY

All content and trademarks in the Services are owned by us or our licensors and are provided "as is" for your personal or internal business use only. You receive a non-exclusive, revocable, non-transferable license to access and use the Services. No other rights are granted.

4. USER REPRESENTATIONS

You confirm your registration info is accurate and updated, you have legal capacity, you will not use bots or unlawful means, and your use complies with applicable law. You acknowledge that AI Features involve the processing of your data by third-party AI providers as described in our Privacy Policy.

5. ACCOUNTS AND SECURITY

You may need an account to use certain features. Keep your credentials confidential; you are responsible for all activity under your account. We may reclaim inappropriate usernames.

6. PURCHASES AND PAYMENT (APPLE IN-APP PURCHASE)

All paid features (including free trials and subscriptions) are offered only through Apple's In-App Purchase (IAP). Apple processes billing and taxes; we do not collect card data. Currency and price are as shown in your App Store storefront and may change per Apple's rules.

Refunds: refunds (if any) are handled by Apple under the Apple Media Services Terms. Contact Apple Support to request a refund.

7. SUBSCRIPTIONS AND FREE TRIAL

Auto-renewal: subscriptions renew automatically until canceled. Your App Store account is charged at confirmation and on each renewal.

Free trial: a 14-day trial may be offered; after it ends, your chosen plan starts unless you cancel before the trial ends.

Manage or cancel: iOS Settings → [Your name] → Subscriptions. Cancellation takes effect at the end of the current period; Premium access ends when the paid term expires.

AI Features: Free-tier users receive a limited number of AI queries per day. Premium subscribers receive unlimited AI queries. We may adjust these limits at any time.

We may change subscription pricing; we will notify you as required by law and via App Store mechanisms.

8. MOBILE APP LICENSE (iOS)

You may install and use the App on Apple devices you own or control, per Apple's usage rules. Do not reverse engineer, modify, or use the App for unlawful or competitive purposes. Apple is not responsible for support beyond what law requires.

9. PROHIBITED ACTIVITIES

You agree not to:

• Violate laws; attempt unauthorized access; interfere with security or operation; use malware or automated scraping; impersonate others; collect users' data without consent; advertise or sell goods using the Services
• Sell, rent, or transfer your account/profile; reverse engineer the App; copy or adapt code; or build a substitute service using our IP

AI-specific prohibitions. You also agree not to:

• Attempt to extract, reverse-engineer, or discover AI system prompts, instructions, or underlying model configurations
• Use AI Features to generate content that is illegal, harmful, abusive, harassing, defamatory, discriminatory, or that violates third-party rights
• Circumvent AI usage limits, rate-limiting mechanisms, or free-tier query restrictions
• Use AI Features to generate content that impersonates licensed professionals (doctors, lawyers, financial advisors, therapists)
• Submit deliberately misleading, fraudulent, or malicious data to AI Features to manipulate outputs
• Use AI-generated outputs in any manner that could cause harm to yourself or others

10. USER CONTENT (PRIVATE USE)

Your notes, lists, journal entries, attachments, ratings, and similar items you add into the App are private to you by default ("User Content"). You own your User Content.

You grant us a limited, worldwide, non-exclusive license to host, process, and display your User Content only to operate and improve the Services (for example, sync and backups, de-identified analytics). We do not publish your User Content to other users. We may remove content if it violates law or these Terms. No public UGC forums or user-to-user messaging are provided.

AI-Generated Content. Content generated by AI Features (including suggested tasks, projects, habits, financial categories, and chat responses) is provided for your personal use within the App. We do not claim ownership of AI-generated content created at your request. However, AI-generated content may be similar to content generated for other users based on similar inputs. AI-generated content is not guaranteed to be unique, accurate, or suitable for any particular purpose.

AI Chat Retention. AI chat conversations are stored for up to 90 days to provide conversation continuity, after which they are automatically deleted. All AI chat messages (both your messages and AI-generated responses) are encrypted using AES-256 encryption at rest for your security. You can delete your chat history at any time within the App.

11. THIRD-PARTY SERVICES

The Services may link to or rely on third-party services (e.g., Apple IAP, sign-in providers). We are not responsible for their content or policies. Review their terms and privacy notices.

AI Provider. When you use AI Features, your data is processed through our AI Provider's services in accordance with our data processing agreement with them. For details on what data is shared and how it is protected, see Section 4 of our Privacy Policy.

12. PRIVACY

See our Privacy Policy: https://purrfectplan.com/privacy-policy. By using the Services you consent to the practices described there, including processing outside your country where lawful.

13. AI AND CONTENT DISCLAIMERS

13.1 AI-Generated Content

AI Features use automated technology to generate responses based on your input and App data. AI responses are generated by third-party artificial intelligence and are not reviewed, verified, or endorsed by us before delivery. You acknowledge that you are interacting with an AI system, not a human. AI may produce inaccurate, incomplete, outdated, or inappropriate responses. You are solely responsible for evaluating and deciding whether to act upon AI-generated content.

13.2 No Professional Advice

Nothing provided through AI Features or any other part of the Services constitutes:

• Medical, mental health, or therapeutic advice
• Financial planning, investment, or tax advice
• Legal advice
• Dietary or nutritional guidance from a licensed professional

All tips, insights, and recommendations (whether AI-generated or otherwise) are lifestyle and self-care suggestions only. Always consult qualified professionals before making decisions that affect your health, finances, or legal matters.

13.3 Financial Information Disclaimer

Budgeting suggestions, savings strategies, spending analyses, and other financial insights provided through AI Features are informational and educational only. We are not a licensed financial advisor, broker, dealer, or planner. AI has access to your financial data within the App but cannot account for your complete financial circumstances outside the App, including external accounts, tax situation, or risk tolerance. Do not rely on AI Features as your sole basis for financial decisions.

13.4 Health and Wellness Disclaimer

Lifestyle tips, habit suggestions, fitness recommendations, wellness insights, and Life Balance Wheel recommendations are general in nature and are not a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of something provided through the Services. If you experience a medical or mental health emergency, contact your local emergency services immediately.

13.5 Accuracy and Reliability

We do not warrant the accuracy, completeness, timeliness, reliability, or suitability of any AI-generated content or any other content provided through the Services. AI Features are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express or implied. AI responses may vary for the same or similar inputs, and may change over time as our AI provider updates its models. We may modify, suspend, or discontinue AI Features at any time without prior notice.

13.6 Your Responsibility

You are responsible for independently verifying any information provided by AI Features before acting on it. Your use of AI Features is at your own risk. We disclaim all liability for any loss, damage, or harm arising from your use of or reliance on AI-generated content.

14. NO EMERGENCY USE

The Services are not intended for emergencies or critical care. In an emergency, call local emergency services.

15. MODIFICATIONS; AVAILABILITY

Features (including AI Features) may change or be discontinued at any time. We do not guarantee uninterrupted availability. We may suspend or terminate access for violations or legal reasons.

16. TERMINATION

We may suspend or terminate your access for breach of these Terms or for legal/security reasons. You may stop using the Services at any time; account deletion is available in-app (see Privacy Policy for data deletion details).

17. DISPUTE RESOLUTION; GOVERNING LAW

Governing law: substantive laws of Ukraine (conflict-of-laws rules excluded).

Informal resolution: before formal action, the parties will attempt to resolve any dispute in good faith for 30 days after written notice.

Arbitration (where permitted by law): any dispute not resolved informally shall be finally settled by arbitration administered by the International Commercial Arbitration Court under the European Arbitration Chamber per its rules.

Class/representative actions are not permitted. If arbitration is not permitted by applicable consumer law, disputes are resolved exclusively by the courts of Kyiv, Ukraine.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, profits, revenue, goodwill, or business interruption, including but not limited to damages arising from your use of or reliance on AI-generated content, AI Features, or any other automated outputs of the Services. Our total liability for all claims will not exceed the amount you paid to us for the Services in the six (6) months before the event giving rise to liability, or USD 50, whichever is greater. Some jurisdictions do not allow certain limitations; in that case the limitation applies to the fullest extent permitted.

19. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from claims arising out of your breach of these Terms, unlawful use, infringement of third-party rights, or your use of or reliance on AI Features and AI-generated content.

20. ELECTRONIC COMMUNICATIONS AND SIGNATURES

You consent to receive notices electronically and agree that electronic signatures and records have the same force as originals.

21. MISCELLANEOUS

These Terms (plus our Privacy Policy and in-app notices) constitute the entire agreement. If any provision is unenforceable, the remainder remains in effect. We may assign our rights and obligations. Failure to enforce is not a waiver.
